The EU-Mercosur Interim Trade Agreement has applied provisionally since 1 May 2026. Qualifying Brazilian goods can receive preferential tariffs when the origin rules and documentary conditions are met.

The agreement does not remove customs formalities. Belgian importers still need an import declaration and any required environmental, food-safety, veterinary, plant-health, or product-compliance records.

This guide explains the process for Brazilian goods entering Belgium, including shipments arriving through the Port of Antwerp-Bruges. It is written for importers, exporters, freight forwarders, and logistics companies.

Belgian Import Requirements

Brazilian goods remain non-Union goods until customs releases them for free circulation. The Belgian importer normally needs an EORI number and a valid basis for acting as importer and declarant.

3 checks should be completed before shipment leaves Brazil:

  • Confirm the full CN or TARIC code, not only the four-digit HS heading.
  • Confirm whether goods qualify for EU-Mercosur preferential origin.
  • Confirm product certificates, licences, or reference numbers.

The representation model should be agreed before shipment. Under direct representation, the broker acts in the importer's name. Under indirect representation, the broker can become jointly liable for the customs debt. DDP does not create an EORI number, VAT registration, or customs representation.

Winz handles Brazil to Belgium customs clearance process including customs declarations, documentation, classification, and compliance review before goods arrive at Antwerp.

Mercosur Tariff Benefits

EU-Mercosur tariff benefits apply only to originating goods meeting product-specific rules. The agreement can create savings for roasted coffee, orange juice, leather footwear, and certain agricultural goods. Some Brazilian exports — iron ore, green coffee, soybeans, soy meal, and chemical wood pulp — already enter at zero normal duty, so preference creates no additional saving.

Sensitive agricultural goods can remain subject to tariff-rate quotas, phased reductions, seasonal rules, or specific duties. Beef and poultry need the correct tariff line, quota conditions, origin proof, and food-safety approval.

Preference and Contract Risks

The agreement is applied provisionally. Supply contracts should state the price with preferential duty, the price with normal duty, and responsibility for missing origin evidence. Belgian customs can review the claim after release and request further evidence.

Mercosur Origin Proof

Preferential duty requires origin evidence accepted under the EU-Mercosur origin protocol, connected clearly to the goods and commercial document. The applicable format depends on exporter status, transitional provisions, consignment value, and issue date. The evidence must match the invoice, goods description, quantity, tariff classification, and exporter details. Brazilian exporters should provide the document before arrival.

Importers calculating landed costs should review FOB shipping terms Brazil Belgium imports for a detailed explanation of how FOB valuation affects duty calculation.

Belgian import VAT is 21% as standard, calculated on customs value, customs duty, and specified incidental costs. Importers holding ET 14.000 authorisation can account for import VAT through the periodic VAT return. A Brazilian business without EU establishment may need a Belgian fiscal representative.

Customs Value and Incoterms

Belgian customs starts with the transaction value and applies required EU valuation additions or deductions. Under FOB, freight and insurance to the EU entry point may need to be added. Under CIF, those costs are normally included. DAP and DDP invoices can include post-entry transport, duty, VAT, and delivery costs, which may be excluded where separately identified. Related-party pricing, royalties, assists, and licence fees can also affect the declared value.

CBAM Steel Rules

The definitive CBAM has applied since 1 January 2026, covering iron and steel, aluminium, cement, fertilisers, electricity, and hydrogen. Brazilian steel falls within CBAM where the full CN code is listed, covering semi-finished steel, flat-rolled products, pipes, tubes, and fasteners. Iron ore is not automatically covered.

A 50-tonne annual threshold generally applies. Where authorisation is required, the importer needs the correct CBAM status and declaration references. CBAM and tariff preference are separate obligations — a product can receive reduced customs duty and remain subject to CBAM. Importers should collect producer emissions data early.

EUDR Requirements

The EU Deforestation Regulation covers cattle, cocoa, coffee, oil palm, rubber, soy, wood, and listed derived products. The main application date is 30 December 2026. Belgian importers should prepare supplier and traceability data — including geolocation, production dates, legality evidence, and quantities — before that date.

Brazil is currently treated as a standard-risk country under the EU benchmarking system. Preparation is important for coffee, soy, cocoa, timber, cattle products, rubber, and relevant derivatives.

Food and Plant Controls

Products of animal origin may need a health certificate, approved Border Control Post, TRACES NT pre-notification, and a validated CHED-P. Regulated plants and plant products can require a phytosanitary certificate, TRACES NT pre-notification, and CHED-PP. Importers must confirm whether the exporting country, region, and establishment are authorised for the specific animal product.

From 3 September 2026, specified imports must meet applicable EU antimicrobial requirements. Customs release does not confirm compliance with all EU market rules — machinery, electrical equipment, chemicals, textiles, and consumer goods can require separate conformity or labelling records.

Clearance Process

Origin evidence, customs value, CBAM data, SPS documents, EUDR references, and carrier-release details should be checked before IDMS filing.

Pre-Arrival Filing

Sea shipments from Brazil require pre-arrival security data under ICS2. The ENS data must match commercial documents — vague descriptions, missing parties, or inconsistent weights can cause a security hold.

IDMS Declaration

Belgian import declarations are filed through IDMS, including the EORI number, TARIC code, customs value, origin, preference claim, VAT treatment, and supporting references. A Mercosur preference claim must have valid origin evidence; customs applies the normal rate where the claim is unsupported.

Customs and Agency Checks

Belgian customs can request documents, examine goods, or refer shipments for further controls. FASFC checks can run separately. Clearance time depends on risk selection, cargo type, document quality, sampling, and terminal availability.

Release Coordination

The carrier may still require an original bill of lading, telex release, or electronic release after customs clearance. Winz coordinates customs release information, bill-of-lading status, and cargo tracking with the appointed carrier or freight forwarder. Winz does not provide container shipping or road transport services.

Animal products require a health certificate and CHED-P. Regulated plants require a phytosanitary certificate and CHED-PP. Other goods may require import licences, conformity documents, organic certificates, or CITES documents. Brazilian suppliers should send the complete file before arrival.

Common Clearance Delays

EUDR Data Gaps

Before EUDR applies, the main risk is poor preparation. After the applicable date, a missing or invalid statement reference can prevent completion of required customs data. Coffee, soy, cocoa, timber, cattle products, rubber, and derivatives involve complex supply chains — data should be collected before booking.

Animal-Product Controls

Animal products can be delayed where the establishment is not approved, the certificate is incorrect, or the shipment reaches an unsuitable entry point. Importers must check the current listing, approved establishment, certificate model, CHED requirement, and Border Control Post.

CBAM Reference Errors

CBAM errors can stop processing where the declaration lacks the correct status, account reference, or threshold treatment. The broker should verify the CN code, annual imported mass, importer status, and document code before filing.

Missing Origin Evidence

Goods without valid Mercosur origin evidence cannot receive preferential treatment. Customs applies the normal rate where the claim is unsupported. A retrospective claim may be possible where the agreement allows it and valid evidence is later obtained.

Valuation Mismatches

Customs can question a value that does not match the invoice, Incoterm, freight cost, or payment records. Related-party pricing, royalties, and unexplained assists create additional review risk.

FAQ — Importing from Brazil to Belgium

Is the trade agreement active?

Yes. The EU-Mercosur Interim Trade Agreement has applied provisionally since 1 May 2026. Brazilian goods receive preferential duty only when they meet the origin rules and have acceptable evidence. Customs declarations, import VAT, and product controls still apply.

What duty applies to coffee?

Green coffee commonly enters the EU at zero customs duty. Relevant roasted coffee lines can face a normal duty around 7.5%. Mercosur preference may reduce the rate where the exact tariff line and origin conditions are met. Coffee also falls within EUDR scope.

Which Brazilian goods can enter?

Most Brazilian goods can enter Belgium when they meet EU customs, safety, and market-access rules. Common categories include coffee, soy products, orange juice, iron ore, steel, leather goods, pulp, machinery parts, and food products.

Who files the EUDR statement?

The first EU operator normally completes the due diligence and submits the statement after the rules apply. A downstream business may retain and pass the reference where another operator completed the required process.

What happens without origin proof?

Belgian customs applies the normal EU duty rate where origin evidence is missing or invalid. A later preference claim may be possible where the agreement allows it and valid evidence is obtained within the required period.

How does FOB affect duty?

FOB Santos does not represent the complete customs value in Belgium. Customs normally adds relevant freight, insurance, and other dutiable costs to the EU entry point where those amounts are not already included.

When should IDMS be filed?

The IDMS declaration should be prepared before arrival where the documents and regulatory references are complete. Pre-lodgement can support faster release, but it does not remove customs risk controls or agency inspections.
